Article 1 — Definitions
In these terms and conditions, the following definitions apply:
• "Entrepreneur": Innova Home Appliances B.V., trading under the name bakeVIA®.
• "Consumer": the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.
• "Distance contract": a contract whereby, within the framework of a system organised by the entrepreneur for the distance selling of products, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the contract.
• "Withdrawal period": the period within which the consumer may exercise their right of withdrawal.
• "Right of withdrawal": the consumer's option to cancel the distance contract within the cooling-off period.
• "Product": the product offered under the distance contract, being a compact mini oven of the bakeVIA® brand.
Article 2 — Applicability
1. These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
2. Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer.
3. Deviations from and additions to these terms and conditions are only valid if expressly agreed in writing.
Article 3 — The offer
1. The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer.
2. Every offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.
3. If an offer has a limited period of validity or is made subject to conditions, this is explicitly stated in the offer.
4. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
Article 4 — The contract
1. The contract is concluded at the moment the consumer accepts the offer and meets the conditions set out therein.
2. The entrepreneur will immediately confirm receipt of the acceptance of the offer by electronic means. As long as receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may dissolve the contract.
3. The entrepreneur may — within legal limits — investigate whether the consumer is able to meet their payment obligations. If, on the basis of this investigation, the entrepreneur has good grounds not to enter into the contract, they are entitled to refuse an order with reasons or to attach special conditions to its execution.
Article 5 — Right of withdrawal
On the purchase of products
1. The consumer may dissolve a contract for the purchase of a product during a cooling-off period of 14 days without giving any reason. The entrepreneur may ask the consumer for the reason for withdrawal but may not oblige them to state their reason(s).
2. The cooling-off period referred to in paragraph 1 starts on the day after the consumer, or a third party designated in advance by the consumer who is not the carrier, has received the product.
3. The consumer must inform the entrepreneur of their decision to withdraw from the contract before the cooling-off period has expired. This must be done by means of an unambiguous statement (by e-mail: info@bakevia.nl).
Article 6 — Obligations of the consumer during the cooling-off period
1. During the cooling-off period, the consumer will handle the product and packaging with care. The consumer will only unpack or use the product to the extent necessary to establish the nature, characteristics and functioning of the product.
2. The consumer is liable for any diminished value of the product resulting from handling the product beyond what is permitted in paragraph 1.
Article 7 — Exercise of the right of withdrawal by the consumer and associated costs
1. If the consumer exercises their right of withdrawal, they will notify the entrepreneur within the cooling-off period by e-mail to info@bakevia.nl.
2. As soon as possible, but within 14 days from the day following the notification referred to in paragraph 1, the consumer will return the product, or hand it over to (an authorised representative of) the entrepreneur. This is not required if the entrepreneur has offered to collect the product themselves.
3. The consumer will return the product with all delivered accessories, in its original condition and packaging.
4. The cost of returning the product is borne by the consumer.
Article 8 — Obligations of the entrepreneur in the event of withdrawal
1. If the entrepreneur enables the consumer to give notice of withdrawal by electronic means, they will send an acknowledgement of receipt without delay after receiving such notice.
2. The entrepreneur will reimburse all payments made by the consumer, including any delivery costs charged by the entrepreneur for the returned product, without delay and within 14 days following the day on which the consumer notifies them of the withdrawal.
3. The entrepreneur will use the same means of payment for reimbursement as the consumer used for the original transaction, unless the consumer agrees to a different method.
4. The entrepreneur may withhold reimbursement until they have received the product or until the consumer demonstrates that they have returned the product, whichever is earlier.
Article 9 — The price
1. During the period of validity stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes resulting from changes in VAT rates.
2. All prices on the website are stated including 21% VAT (for consumers in the Netherlands).
3. For consumers in other EU member states, a different VAT rate may apply in accordance with the OSS scheme. The applicable rate is shown during the checkout process.
Article 10 — Conformity and warranty
1. The entrepreneur guarantees that the products comply with the contract, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations in existence on the date the contract was concluded.
2. All bakeVIA® products are CE-certified in accordance with the LVD (2014/35/EU), EMC (2014/30/EU) and RoHS (2011/65/EU) directives.
3. The entrepreneur provides a 2-year manufacturer's warranty on all products, counting from the date of delivery.
4. The warranty does not apply if the damage is the result of improper use or normal wear and tear.
Article 11 — Delivery and performance
1. The entrepreneur will exercise the greatest possible care when receiving and executing orders for products.
2. The place of delivery is the address that the consumer has made known to the company.
3. Orders are shipped from the entrepreneur's distribution centre in Venlo, Netherlands.
4. Delivery times: Netherlands and Belgium 1-2 working days, Germany 2-3 working days, other EU countries 3-5 working days.
5. If delivery is delayed, or if an order cannot be executed, or can only be executed in part, the consumer will be notified no later than 30 days after placing the order.
Article 12 — Payment
1. Unless otherwise agreed, the amounts owed by the consumer must be paid via the payment methods available on the website (iDEAL, Visa, Mastercard, PayPal, Bancontact, Klarna).
2. Payments are processed via Mollie B.V., a certified payment service provider.
3. The consumer has the duty to report any inaccuracies in payment details provided or stated to the entrepreneur without delay.
Article 13 — Complaints procedure
1. The entrepreneur has a sufficiently publicised complaints procedure and handles complaints in accordance with this complaints procedure.
2. Complaints about the performance of the contract must be submitted to the entrepreneur fully and clearly described within 7 days after the consumer has discovered the defects, via info@bakevia.nl.
3. Complaints submitted to the entrepreneur will be answered within a period of 14 days counting from the date of receipt.
4. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within the 14-day period with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.
5. If the complaint cannot be resolved by mutual agreement, the consumer may submit a dispute to the competent Dutch court.
Article 14 — Applicable law
1. Contracts between the entrepreneur and the consumer to which these terms and conditions apply are governed exclusively by Dutch law.
2. The competent court is the District Court of Rotterdam.
Article 15 — Additional or deviating provisions
Additional provisions or provisions deviating from these terms and conditions may not be to the detriment of the consumer and must be recorded in writing.
